FLEMINGSBURG, Ky. — Property owners in Flemingsburg who use shipping containers for storage, or are considering purchasing one, will now have to comply with new city regulations governing their placement, size, appearance, and use.

The City of Flemingsburg has announced the adoption of Ordinance No. 8-26-2, establishing guidelines for shipping containers located within city limits.

According to city officials, the ordinance is intended to address public safety concerns, maintain neighborhood appearances, and ensure shipping containers are used appropriately on residential, commercial, and industrial properties.

Restrictions on Residential Properties

Under the new ordinance, residential property owners are limited to one shipping container per lot.

Containers on residential properties cannot exceed 8 feet in width, 8½ feet in height, and 20 feet in length.

Additionally, containers must be placed in the rear yard, comply with applicable setback requirements, and be located on property containing an existing lawful principal structure.

A zoning permit is generally required before placing a container on the property.

Commercial and Industrial Properties

Businesses and industrial property owners are permitted up to three shipping containers per lot, although additional containers may be authorized through an approval process.

Containers on these properties may measure up to 8 feet wide, 8½ feet high, and 40 feet long.

Placement and screening requirements also apply.

Appearance and Maintenance Requirements

The ordinance also addresses the physical condition and appearance of shipping containers.

Property owners must maintain containers in good condition, free from rust, damage, and visible deterioration. Containers must also be painted a neutral or otherwise approved color.

City officials say these requirements are intended to prevent improperly maintained storage containers from negatively affecting surrounding properties.

Shipping Containers Cannot Be Used as Homes Without Authorization

The ordinance restricts the use of shipping containers as residential dwellings or sleeping quarters.

Such uses are prohibited unless specifically permitted under applicable regulations.

What About Existing Containers?

Property owners who already have shipping containers may be permitted to continue using them.

According to the city's announcement, containers lawfully installed before the ordinance became effective may remain in use, provided they satisfy the ordinance's conditions.

Property Owners Encouraged to Contact City Hall

City officials are encouraging residents and business owners to consult with City Hall before purchasing, moving, or installing shipping containers.
